You've indicated that your business has an EIDL over $200,000 and or that you signed for the EIDL as a sole proprietor (i.e., an individual). In these situations, you are likely personally liable for the EIDL, which means the federal government will pursue you personally for repayment if your company doesn’t repay the loan. Your options for relief from this personal liability will be filing for personal bankruptcy or submitting an offer in compromise, both of which require a full disclosure of your income and assets. If you have the ability to repay the loan (ex., significant income, multiple investment properties with more equity than the loan amount, etc.), it is likely that both of these options will require you to repay the loan in full and The Wink Law Firm will not be able to help you. In this situation, we recommend paying the loan because the terms of repayment for EIDLs are very favorable.

If you believe you do not have the ability to repay the loan, we recommend exploring personal bankruptcy because it is typically more efficient and provides greater protection for your property than an offer in compromise. Our experience is that the SBA is difficult to work with for offers in compromise. The Wink Law Firm can only represent people and small businesses in Colorado in bankruptcy.
